TOS | Dynamic Cinema

The following is our Terms of Service, otherwise known as the Listing Production Agreement, which applies for each booking. By booking with Dynamic Cinema Productions, you agree to the following terms of the document during the time of booking.

This Listing Production Agreement (the "Agreement") is made and entered for each individual project upon booking by Dynamic Cinema Productions and the Client(s) submitting the booking request, collectively the "Parties."

The Client(s) desire to contract Dynamic Cinema Productions for the production of, but not limited to, real estate photography, videography, aerial drone photography or videography, 3D matterport, listing website(s), and other marketing services (the "Services").

Client Obligations: Client(s) agree to provide access to the property for all media production, to ensure the property is staged and ready for media production, and to communicate any special requests or instructions in a timely manner. We require the property to be photo-ready at the start of the booking appointment. If the property is not ready, we will charge a cancellation fee and you can reschedule with us.

Preparing the Home: Interior

Turn on all lights including lamps.
Pull up all blinds to allow for natural light.
Replace light bulbs that are burnt out.
Turn off all fans, televisions, computer screens, etc.
Remove all trash cans and pet items.
Clear kitchen counters of excess items.
Remove unnecessary furniture and decorations.
Clear appliances of magnets and clutter.
Clean windows and mirrors.
Remove floor mats.

Preparing the Home: Exterior

Turn on all exterior lighting possible.
Clear any outdoor clutter by storing in the garage or on one side yard below window levels.
Clear cars from the driveway.
Hide garbage/recycling cans and yard equipment.
Open patio umbrellas if applicable.
Turn on all water features if applicable (waterfall, fountains, etc)
Remove pool sweep if applicable.
Remove outdoor cooker covers if applicable.

Rights to Media: Dynamic Cinema Productions retains all rights to the media produced for the Client(s). Client is granted a non-exclusive, non-transferable license to use the media for the purpose of marketing and advertising the property for sale or rent. External parties must pay a licensing fee to access and use images.

Turnaround Time: Photos will be completed and delivered the day following the production date. Client understands that photo deliverables will be available within a 36 hour period following the production completion. All other media files will be completed and delivered within a 72 hour period. If a URL link is wanted for a video tour, the realtor must request to have the video uploaded to YouTube prior to shooting the home.

Travel Fees: Client agrees to pay for any additional travel fees based on location of the property from Dynamic Cinema Productions’ office location at: 9960 Business Park Dr, Suite 140, Sacramento, CA 95827.

Travel fees are as follows: 0-30 miles of travel are at no extra charge, 31-50 miles will be a $50 charge, 76-100 Miles will be a $100 + 25c/mile charge and 101-250 Miles will be a $150 + .50c/mile.

Payment: Client(s) agree to pay the agreed-upon fee for services upon booking or by media delivery if agreed by “Parties”. A late fee may be assessed for any payments not received within 3 days of media delivery.

Cancellation and Rescheduling: Client understands that any paid bookings that resulted in a cancellation or reschedule will not be reimbursed, but will be credited towards the next booking. Client understands that if a property is canceled or rescheduled within a 24 hour period from the scheduled production time it will result in a $75 cancellation fee.

Liability: Dynamic Cinema Productions is not liable for any damage to the property or personal injury that may occur during media production. Clients agree to indemnify and hold Dynamic Cinema Productions harmless from any claims, damages, or losses arising from the use of the media produced.

Governing Law: This agreement shall be governed by and construed in accordance with the laws of California.

Entire Agreement: This Agreement between Dynamic Cinema Productions and Client(s) supersedes all prior agreements, negotiations, or understandings.

Summary: Client(s) agree to these Terms of Service. Dynamic Cinema Productions reserves the right to modify this Agreement at any time and will provide notice of any changes to Client(s).
